Rule 40A
Provisions relating to level of non-graded posts

(1) Nepal Police will have the following rank in the unranked post:-
(a) first level, (b) second level, (c) third level, (d) fourth level, (e) fifth level. :-
(a) Second level to those with five years or more and less than twenty-four years of service,
(b) Tertiary level for those with ten years or more but less than fifteen years of service,
(c) Fifteen years or. For those with less than twenty-three years of service, the fourth level,
(d) Fifth level for those with twenty years or more of service.
(4) Notwithstanding anything contained in sub-rule (3), no increase shall be made in the following cases:-
(a): Throughout the period of suspension of pay increment,
(b) In case of reduction in salary increase or reduction in the basic scale or not received, up to one year from that date.
(5) The salary according to the level of sub-rule (3) will be as specified by the Government of Nepal.
(6) When increasing the level of unranked employees of Nepal Police, it will be done in such a way that it will be effective from the day after the completion of the service period as per sub-rule (3).
(7) Notwithstanding anything contained in sub-rule (6) at the time of commencement of this rule, this rule shall commence in the case of police personnel who have completed their service period as per clauses (a), (b), (c) or (d) of sub-rule (3) at the time of commencement of this rule. Held: The level will be increased with effect from the date.
(8) Regardless of what is written in sub-rules (6) and (7), if the punishment as per sub-rule (4) is imposed during that period, the level shall be increased so that it will be applicable from the next day after the expiry of the period.
